How Do I Become a U.S. Citizen?

A foreign national may gain U.S. citizenship through naturalization, if he or she meets the following basic requirements (among others):

• Continuous residency in the U.S. while a legal permanent resident ("green card holder") for 5 years, or for 3 years if you are married to a U.S. citizen;
• Physical presence in the U.S. for half the legally required time, or two-and-a-half years for those not married to U.S. citizens and one-and-a-half years for those who are; and
• Good moral character within the 5 years leading up to the filing for naturalization.

Other requirements include basic English literacy and an oath of allegiance. Note: if the applicant has any criminal record the "good moral character" requirement may not be met, even if the incident occurred more than 5 years ago. Any legal permanent resident considering naturalization who has had any contact with U.S. law enforcement (with the exception of parking tickets) should consult with an attorney before filing for naturalization.
