Spouses, Parents, and Children of U.S. Citizens
Spouses, parents, and minor, unmarried children of adult U.S. citizens are given priority in the “immediate relatives” immigration category. There is no wait-list to receive permanent residence when a U.S. citizen petitions for an immediate relative, and the spouse, parent, or child will receive the “green card” immediately as soon as the application is approved. However, if the immigrant receives his or her permanent residence through marriage, the status is considered “conditional”, and the husband and wife must apply again to remove these conditions two years later.
Other Relatives of U.S. Citizens and Legal Permanent Residents
Married or adult children of U.S. citizens, siblings of U.S. citizens, and spouses and children of legal permanent residents can also be sponsored by their relatives. However, wait times for “green cards” vary according to the immigrant relative’s category, as listed in the visa bulletin.
Fiancé Visas (K Visas)
U.S. citizens may also file immigrant visa petitions for their intended spouses abroad. Then the immigrant fiancé(e) will be scheduled for a visa interview with the U.S. consulate abroad. Once approved, the intended spouse must then marry his or her U.S. citizen sponsor within 30 days of entry.
