Non-Profits, Research Organizations, Institutions of Higher Education

Certain non-profits, research organizations, and institutions of higher education, such as universities, may hire skilled workers with Bachelor’s degrees under the H-1B visa program without limitation, as they are exempt from the H-1B visa cap. An H-1B allows the foreign national to work for a period of 3 years, and is renewable for an additional 3 years. To be eligible for the cap exemption institutions of higher education must be accredited and usually must award a Bachelor’s degree. Non-profit organizations must either be research organizations, or must also be associated or affiliated with an institution of higher education, such as university hospitals. Government research organizations are also cap exempt.

Information Technology Professionals

IT professionals with Bachelor’s degrees are generally eligible for H-1B visas, a temporary visa with a duration of 3 to 6 years. However, with the extremely limited number of H-1B visas available, technology companies may only be able to hire away foreign professionals who already have an H-1B visa as employees of other companies. Often the best solution for hiring in-demand IT professionals is to sponsor them for legal permanent residence.

If the foreign employees have been working for the company abroad, they may be eligible to come to work for the company’s U.S. branch, or to start up an operation for the company in the U.S. as an intra-company transferee, with an L visa. An individual with the means to invest substantially in the U.S. or to carry on trade may be qualified for an E.

Fashion Industry Professionals

Successful fashion models may be eligible for H-1B visas. However, the number of H-1B visas made available each year is limited. Extremely talented models or other industry professionals, such as hair stylists and makeup artists, who have risen to the very top of the industry may be eligible for an O visa, as a person of “extraordinary ability”.
