Immigration Courts

If a foreign national does not have a legal immigration status in this country, or commits certain crimes, Immigration and Customs Enforcement (“ICE”) may try to remove him or her. An Immigration Judge presides over these court proceedings which are held at US Immigration Courts across the country. These are formal court hearings and should be taken very seriously as you can be physically deported and even barred from reentering. Only an Immigration Judge can determine if you are removable, deportable or inadmissible and whether you have relief from removal. If the Immigration Judge denies relief, you may appeal to the Board of Immigration Appeals.

Various defenses and strategies against removal may be available, including:

  • Asylum
  • Withholding of removal
  • Voluntary departure
  • Granting an application for permanent legal residence
  • Cancellation of removal
  • Waivers
  • Motions to reopen deportation orders

Federal Courts of Appeal

If your claim for relief is denied by the Board of Immigration Appeals, it may be appealed to the federal courts of appeal. Federal litigation is complex and requires experienced litigators with appellate experience, as it is the last resort for the majority of immigrants facing deportation.

Appealing an immigration decision is a difficult process. It is, however, often the last resort. We are known for our success with appeals and motions to reopen.

Based in Washington, D.C., we provide caring, compassionate and comprehensive immigration legal counsel to clients in proceedings before the Arlington and Baltimore immigration courts, and the 4th Circuit Court of Appeals.
